Winter Shopping Spree Competition Terms and Conditions
1. The Promoter
The promoter is ESMA Holdings Pty Ltd (ACN 620 695 561) as Trustee for the ESMA Family Trust, trading as 39 Degrees (ABN 71 566 590 446), of Melbourne, Victoria, Australia (the Promoter).
2. Promotion Period
The promotion commences on 22 May 2026 and closes at 11:59pm AEST on 4 June 2026 (Promotion Period). Entries received after the closing date and time will not be accepted.
3. Eligibility
Entry is open to Australian residents aged 18 years or older at the time of entry. Directors, management, employees and immediate families of the Promoter and its related entities are not eligible to enter. The Promoter reserves the right to verify the validity and eligibility of all entries and to disqualify any entrant who tampers with the entry process or who submits an entry that does not comply with these terms.
4. How to Enter
To enter, eligible entrants must complete both of the following steps during the Promotion Period:
(a) Sign up by providing their first name and email address via the competition landing page at 39degrees.com.au/pages/win; and
(b) Nominate at least one friend by tagging them in the comments of any designated 39 Degrees competition post on Instagram or Facebook.
Both steps must be completed for a valid entry. Completion of only one step does not constitute a valid entry.
No purchase is necessary to enter.
5. Bonus Entries
After nominating their first friend, entrants may nominate additional friends by tagging them in the comments of any designated 39 Degrees competition post. Each additional nomination beyond the first earns the entrant 5 bonus entries into the draw. There is no limit to the number of additional nominations an entrant may make.
6. Prizes
There are ten (10) prizes to be won. Each prize consists of a $1,000 AUD store credit redeemable at 39degrees.com.au. The total prize pool value is $10,000 AUD.
Prizes are not transferable or exchangeable and cannot be redeemed for cash. Store credit must be used in a single transaction or as otherwise specified by the Promoter. Any unused portion of the store credit will not be refunded. If a prize (or part of a prize) is unavailable, the Promoter reserves the right to substitute the prize (or that part of the prize) with a prize of equal or greater value.
7. Winner Selection
Winners will be drawn at random from all valid entries on 5 June 2026. The draw will be conducted electronically by the Promoter at its premises in Melbourne, Victoria.
8. Winner Notification
Winners will be notified by phone call and email on 5 June 2026 using the contact details provided at the time of entry. Winners must respond and confirm acceptance of the prize within 3 days of notification. If a winner cannot be contacted or does not claim the prize within 3 days, the Promoter reserves the right to withdraw the prize and conduct a redraw.
9. Publication of Winners
By entering, entrants agree that the Promoter may publish their first name and last initial (e.g. Jane D) on its website and social media channels for the purpose of announcing winners. Winners will not be required to participate in any further promotional activity without their express consent.
10. Privacy
The Promoter collects personal information from entrants for the purpose of conducting this promotion. By entering, entrants consent to the Promoter collecting and using their personal information for this purpose and for future marketing communications. Entrants may opt out of marketing communications at any time by contacting team@39degrees.com.au or using the unsubscribe function in any marketing email. The Promoter will handle personal information in accordance with Australian Privacy Principles.
11. Social Media Disclaimer
This promotion is in no way sponsored, endorsed, administered by, or associated with Instagram, Facebook, or Meta Platforms, Inc. Entrants acknowledge that they are providing information to the Promoter and not to Instagram, Facebook, or Meta Platforms, Inc.
12. Limitation of Liability
To the extent permitted by law, the Promoter and its associated agencies and companies will not be liable for any loss (including but not limited to indirect or consequential loss), damage, personal injury or death that is suffered or sustained by any entrant in connection with this promotion or the acceptance and use of any prize. Nothing in these terms limits, excludes or modifies any consumer rights under the Australian Consumer Law.
13. General
The Promoter reserves the right to cancel, suspend, modify or terminate the promotion if any fraud, technical failures or any other factor beyond the Promoter's reasonable control impairs the integrity or proper functioning of the promotion. The Promoter reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process or who does not comply with these terms and conditions.
These terms and conditions are governed by the laws of Victoria, Australia.
Any failure by the Promoter to enforce any of its rights under these terms shall not constitute a waiver of those rights.
14. Withdrawal
If an entrant wishes to withdraw their entry at any time, they may do so by contacting the Promoter at team@39degrees.com.au.
